Justice will be served for the family of an unarmed homeless man who was left slain by an LAPD officer in Venice last year. According to the Los Angeles Times, lawyers for the city of Los Angeles have reached a $4 million settlement with the family of Brendon Glenn.

The deal, which is provisional, comes as prosecutors decide whether to charge officer Clifford Proctor in Glenn’s death. Court documents show that lawyers who are representing the Glenn family informed the court two weeks ago that they had reached a deal with the city this fall. U.S. District Judge Manuel L. Real dismissed the case after being notified about the settlement.

If the city council approves the deal then lawsuits filed in both state and federal courts by Glenn’s family would be dismissed. If the settlement is not confirmed, the federal case could possibly be reopened within 60 days. “This has impacted this family’s life each and every day,” the family’s attorney V. James DeSimone, notes the report. “It has really robbed them of a lot of the joy of living. There are reminders each and every day of how much they miss Brendon.”

Brendon Glenn, 29, was shot and killed on May 5, 2015, during an altercation with police officials. The LAPD claims that he was trying to reach for one of the officer’s gun holsters. Video footage of the incident showed that his hand was nowhere near the holster. Glenn, who was homeless, lived along the Venice Beach boardwalk and frequented the local skate park.
